These Terms of Service (“Terms”) govern your use of the website westsupply.com.au (the “Site”) and any purchases you make from West Supply Pty Ltd (“West Supply”, “we”, “us” or “our”).

By accessing the Site or placing an order you agree to be bound by these Terms, our Privacy Policy, Shipping Policy and Refunds & Returns Policy.

If you do not agree to these Terms, please do not use the Site or place an order.

2. Eligibility

You must be at least 18 years of age to use this Site and place orders. By using the Site you represent that you are 18 years or older.

3. Products and Pricing

  • Product descriptions, images and prices are subject to change without notice.
  • We make every effort to display colours and images accurately, but we cannot guarantee that your device’s display will be exact.
  • We reserve the right to limit quantities, refuse orders, or cancel orders (for example in cases of pricing errors, suspected fraud, or bulk/reseller activity). If we cancel an order after payment we will refund you in full.
  • Prices are in Australian dollars (AUD) and include GST where applicable unless otherwise stated.

4. Orders and Payment

Placing an order constitutes an offer to purchase. We will confirm acceptance by sending an order confirmation email. You agree to provide accurate, complete and current billing, shipping and contact information.

5. Shipping and Delivery

Shipping is handled in accordance with our Shipping Policy. Delivery times are estimates only.

6. Returns, Refunds and Consumer Guarantees

Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other applicable law that cannot be excluded.

In addition to your statutory rights, we offer a voluntary change-of-mind returns process as set out in our Refunds & Returns Policy.

You agree not to:

  • Attempt to gain unauthorised access to any part of the Site or systems
  • Transmit viruses, malware or other harmful code

11. Limitation of Liability

To the maximum extent permitted by law (and subject always to the non-excludable consumer guarantees under the Australian Consumer Law):

  • We exclude all other warranties, representations and conditions (whether express or implied) that can lawfully be excluded.
  • We will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill arising out of your use of the Site or any products purchased from us.

Our total liability to you for any claim arising out of these Terms or your use of the Site or products will not exceed the amount you paid us for the relevant product(s).

You agree to indemnify and hold harmless West Supply and its officers, employees and agents from any claims, losses, damages, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site or products, except to the extent caused by our negligence or breach of the Australian Consumer Law.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of Queensland, subject always to any rights you have under the Australian Consumer Law.

14. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page. The updated Terms will apply from the date of posting. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
